Estate Planning for Young Families

For most young parents, the thought of dying unexpectedly is not something they care to think about, let alone plan for. But estate planning is as important a part of parenthood as planning for college. Probate law and estate planning are extremely complex and should be handled by an attorney at a credible law firm. What follows are a few questions commonly asked by young families during the estate planning process.

  • What happens if I choose not to have a will?
Simply ignoring your estate planning responsibilities will leave your family with a big legal mess, such as who will care for your children. The assets of people who do not leave a valid will are distributed by a court appointed administrator.

  • Do I really need a lawyer to look over my will or can I just write it down?
Probate laws vary from state to state. In some place, the bare minimum standard is a notarized document, while others require an attorney’s help. Whatever the law is in your state, it's always good to have any will, living will or trust looked over by an attorney from a law firm that handles estate planning.

  • What's the difference between an executor and an administrator?
Administrators and executors both administer the distribution of assets. The difference is that an executor is named in the will by the deceased. Administrators are court appointed lawyers who represent estates that lack a valid will.

  • When should I start my estate planning?
Many couples choose to begin writing their will shortly after their marriage. Couples with children are advised to write a will before their child is even born.

  • What does a probate court do?
Probate courts document the validity of a will so that the executor or administrator can begin distributing assets like property and businesses.

There are many professionals that work for law firms as estate planning attorneys. As you may know, this is a very important branch of law that involves the representation of estate owners, and handling their wills, land, and trusts. While some of these clients are elderly, others suffer from a disability, and require around the clock care. As a lawyer in this field, it is your job to handle living probates or official proof of wills. You may also have to deal with social security funds, property distribution, and the protection of your client’s assets.

The legal powers of an estate planning attorney are broad. In compliance with the laws and your client, it is your job to provide legal services and care to estate owners in order to assist them with their assets and land after they pass on. Since this business and line of work involves law and legal representation, you must first acquire a degree and become certified as an attorney. This way you will be more knowledgeable to handle legal liabilities, trusts, financial assets, land distribution, and any charitable causes the estate owner is donating to. Since there are a number of law firms in the United States that deal with estate planning and living wills, there is a lot of room for employment in this field.

As a lawyer dealing with estate planning, asset protection, land taxes and property distribution, you are likely to work with a number of different estate owners, as well as other attorneys at times.
