Questions to Ask a Bail Bondsman
If you've been ordered to make a court appearance, you probably have a lot of questions about the nature and structure of a court trial. You probably also have a lot of questions about bail bonds. Some of your questions may be included here:

  • What is a surety?
A surety, or a guarantee, is a promise made by one party to another. For instance, one party may pledge the other party money, or some other type of fee, as bail for a court appearance.

  • What exactly does a bail bondsman do?
A bail bondsman, or agent, acts as a surety for any party who needs to appear in a court of law and may be tempted to skip out. Bail bondsmen, or agents, work with defendants and incarcerated criminals who have been ordered to appear at state and federal courts or jails. Most bail bondsmen are on call 24 hours a day, every day, to help their clients post bail for their trials.

  • What is a bounty hunter?
A bounty hunter is a bail enforcement agent of sorts. Bounty hunters, much like bail bondsmen, are usually available 24 hours a day. Bounty hunters can be quite costly, but they efficiently track down men and women who avoid their jail sentences. They often track down people who are on trial for immigration issues or other minor infractions.

  • How much money is required to post a bail?
The amount of money required to post bail varies wildly from trial to trial. You should do some research before you appear in court to get a better understanding of how much a particular bail might cost.

A bail bond company offers to post the money to get you out of jail - but at a price. Typically the company will require a fee for their services, which is often a percentage of the total cost of your bail. The bail amount is determined by the court and varies depending on the state or federal law that was broken, whether immigration, traffic or other violation. The court agent will also determine whether you are a flight risk who might skip town. When they have the surety you will appear at your trial, your bail will cost less. Those with larger bail amounts can call a bail bond company that is usually on call 24 hours a day to help those who get incarcerated and need help posting their bail to get out of jail. When you post bail through a 24 hour company, you are free to leave jail to prepare for your trial. The agent of the company puts up the money for your temporary release, on the guarantee from you that you will appear in court on your appointed day. At that time, the court will refund the amount of your bail, and the money can go directly to the bail bond company. However, you will be responsible for the additional amount of money necessary to cover the bail bond company's fee. If you don't show up in court, you will responsible for the full bail amount, and a bounty hunter may be sent out to track you down and enforce your jail time once again.
