Questions to Ask a Workers' Compensation Attorneys

Some individuals are bullied by your employer after they file a workers’ compensation claim because of an accident and return to work. You may be verbally harassed or denied requests that are granted to coworkers. Your hours may be cut without your consent. Your personal injury may result in a permanent disability. Though workers’ compensation insurance usually takes care of medical expenses and wages for lost time at work, you may need an attorney. You and the attorney may improve workplace safety and treatment after an acccident for others.

  • Do you have experience representing clients with amputation injuries?
The attorney may answer that the law firm has a history of representing clients from the construction industry. If the lawyer has experience winning cases for plaintiffs injured in factories by equipment that caused amputation, then you have selected the right one.

  • What do you do differently when handling a case for a paralyzed client?
Sometimes the employer and the insurance company try to limit the amount of monetary ward and medical care a client receives for personal injury. In many cases, the paralyzed client will need a live-in nurse and disability accommodations for his or her home. An attorney who has experience requesting, winning, and arranging for lifelong nursing care to compensate clients that have been paralyzed by a workplace injury is prepared to help you too.

  • If my spouse died from a fall at work, can I sue the company for the accident?
Some households have a single income earner. When that income earner dies because of negligence by the company, the family member may be able to sue because he or she is a dependent. The company would compensate the surviving spouse. Ask your attorney because laws vary from state to state.

Workers who have been injured due to an accident on the job will be looking to be compensated for the time lost during recovery. While many companies follow state laws to cover these employees, some folks decide not to pay the benefits those suffering from personal injury need. Attorneys and their firms can be called on to help those receive what they fairly deserve.

In order to be an attorney, you must obtain an undergraduate degree, be accepted and complete law school, and pass the bar exam. While in the occupation, you must either work with or start your own legal firm to find clients. To specialize in this particular field, you must know the state and federal laws that apply to accident compensation insurance and claimant rights. You must not only be willing to help laborers involved, but also be willing to pro-actively aid companies in order to prevent personal injury or illness on the job. You must work with medical doctors to assess disability, rehabilitation, or therapy needs for injured workers in order to get folks their right benefits. Be prepared to point out fraudulent claims by either individuals or companies in order to make sure your client is fully compensated in their settlement.

With individuals, be prepared to file suit if the client is wrongfully terminated from their position. These laws can be a bit tricky as each state has different employment laws, so take part in seminars to brush up on new practices. Read up on new rules and regulations as often as you are able.
