Questions to Ask a Real Estate Attorney

Though it's possible to make real estate deals by yourself, it's generally a good idea to hire a firm or attorney. Real estate lawyers are more likely to be able to handle the various snafus that can arise in closing a deal. They can be immensely helpful in deciphering hard-to-read legal contracts. They can offer expert assistance in buying and selling property. But before you hire an attorney who deals in property law, there are a few important questions you should ask.

  • How much experience does the lawyer or firm have?
    You probably already believe than an experienced attorney can bring more to the table than a novice (although it's worth pointing out that the relatively inexperienced lawyer may charge less), but this isn't the only important consideration. Check to make sure the attorney you will be working with has experience in the specific aspects of your type of transaction. For instance, if you have to worry about deed restrictions or liens, you should try to find someone with experience in closing these types of deals.

  • Who will be working on the case?
    It's not uncommon for firms to have some of the other attorneys there deal with certain aspects of the case. If this is so, you will probably want to meet with them to ensure that you can work with them comfortably.

  • How will I be billed?
    As a general rule, you will be billed hourly, but sometimes it may be possible to negotiate a flat rate. If you can't, then you should try to get a written estimate, preferably one that includes an upper limit that you can be charged.
