Questions to Ask a Notary

If you need a legal document notarized, you will need to locate an experienced and professional notary public. Before using the services of a notary public there are a few questions you should consider asking.

  • What services does the notary public offer?
Since notaries are appointed by state governments, the tasks they are authorized to complete vary. All notaries authenticate the signatures on legal documents, like affidavits, power-of-attorneys, and real estate deeds. However, some notaries are authorized to take on additional tasks like providing marriage licenses and certifying passport applications. Also, some notary publics, referred to as signing agents, provide mobile services, traveling to parties of real estate transactions to notarize signed forms.

  • What are the fees for the notary public’s services?
Some states set standard fees for notary services, and others allow notaries to set their own fees. If you are looking for affordable notary services, some banks and private businesses notarize documents for free or at discounted prices for their customers. If you need a mobile signing agent to come to you to notarize documents, there may be additional fees based on the travel involved.

  • In what areas will the notary travel to notarize documents?
Notaries often work in association with a mortgage, escrow, or title company. They travel to parties involved in real estate deals to witness and certify signatures. It is not uncommon for a notary to work in association with out-of-state real estate businesses to obtain signatures within a specific geographical area. Some states limit the area in which a notary’s commission is valid to one region, for instance a county, so you will want to be sure a notary can work in the area where you need them.

All notary public experts are, in fact, appointed officials. The requirements to become one vary from state to state. Their appointment gives them the right to act as an official witness to legal affairs. They handle highly sensitive and private documents and sometimes classified material. As such, they are bound by confidentiality and privilege. Part of their duty is to ensure people are who they claim to be. In some cases, a notary may even be required to administer an oath. Notaries may work independently or for a corporation or company, or directly for and with the local government.

Notary signing agents specialize in handling the signing of loans, especially mortgages. They generally work as freelancers or for the bank. As they are expected to be mobile and travel to and from the customer's home or office, they need access to a car. Some freelance signing agents work entirely as mobile notaries and may not have an office. They may charge for travel expenses, or include them in their fee.

Notaries are required to be licensed. They may also seek certification from a professional association. Requirements vary from state to state, but generally include paying a fee, posting a bond and possibly passing an exam. A notary public must also purchase an official seal. It is essential to be aware of the specific rules of the state in which a notary operates, such as rules involving signature stamps and electronic signatures.

A notary signing agent does not just witness the loan itself. They may also be required to courier documents, such as application forms, and checks. They often have to witness the signing of application forms and in some cases may take sworn statements. Many work with residential mortgages and other loans, but commercial and business loans also require their services.
