Questions to Ask Immigration Law Attorneys

Before you hire immigration law attorneys, you want to make sure that you choose someone who can do the job right. Without the help of an experienced attorney, you could find that it is much more difficult for you to understand the complex laws surrounding green cards, immigration, visas, and passports. Use these questions to decide which attorney you will hire.

  • How long have you worked in immigration law?
Ideally, you want someone who has worked in this field for several years. They should have seen enough cases to fully understand the ways that individuals and businesses can use immigration reform to their advantage.

  • Does your firm offer pro bono services?
Pro bono services are often reserved for clients that cannot afford to pay for lengthy immigration, criminal, and defense cases. If you cannot afford these services, then consider finding a lawyer that will work on your case pro bono.

  • Can you explain the difference between a green card and a passport to me?
Any lawyer knows the difference between a green card and a passport. This question isn’t meant to help you find a particularly knowledgeable attorney. It is, however, meant to help you find an attorney that can explain concepts to you in understandable terms.

  • Will recently enacted reforms affect my case?
Although you want an attorney that has a lot of experience working with criminal, personal, and civil cases, you also want to make sure you choose someone who understands recent changes in the law.

Immigration law offers the possibility of participating in reform of complicated regulations. Due to the attention this issue receives, firms are not short of work.

An attorney who wishes to work in immigration law needs to attend law school and pass the bar. Taking classes on the specifics of immigration and citizenship is a requirement. Attorneys need to know not just American immigration law but that of other countries.

If attorneys may need to advise businesses on requirements for employment visas, corporate law basics will also prove useful. Lawyers must know how to obtain a green card, and also the most common forms of fraud. Many fraud issues concern marriage, but green cards are valuable on the black market. They need to understand the status of permanent residents, the process to become a citizen, and obtain a passport. It is essential to understand how deportation works. They need to be able to advise clients regarding interviews as well as understanding the classes of visas. As immigration interviews can be highly personal, attorneys need to be comfortable dealing with those issues.

Often, attorneys have to work with illegal aliens. While immigration lawyers are not criminal defense lawyers, they may become involved in these cases. Though a permanent or temporary resident alien who faces a criminal conviction is likely to be automatically deported, it may be necessary for the attorney to step in and work with the defense lawyer to ensure that plea bargains are kept as a last resort.

Immigration lawyers may find themselves involved in representing refugees and asylum seekers. This work is often pro bono and done to improve the firm's reputation.

As immigration law becomes more complicated and attention to reform increases, the need for attorneys grows.
